Privacy Policy

PollMiner is a product of Smartscreen LLC, doing business as pollminer.com.

This Privacy Policy explains how Smartscreen LLC, doing business as PollMiner and pollminer.com (“PollMiner,” “we”), handles personal information. It covers two roles: information about you (our account holder) that we control, and information about the people you contact, which you control and we process on your behalf.

1. Two roles: controller vs. processor

For your account information, we act as the data controller. For the contact data you upload and the calls and messages you run — including your contacts' names, phone numbers, and any recordings or transcripts of your outreach — you are the controller and we act as your processor / service provider, handling that data only on your documented instructions to provide the Service. You are responsible for having a lawful basis and any required notices and consents for that data.

2. Information we collect

  • Account information — your name, email, company, password (hashed by our auth provider), and time zone.
  • Contact data you upload — the names, phone numbers, emails, companies, notes, tags, and any custom fields in your lists, including voter-file fields such as precinct, party registration, or turnout history. Political-opinion and affiliation data is treated as sensitive in some jurisdictions; as the controller of your lists, you are responsible for a lawful basis to process it.
  • Call and message content — call metadata, and, where you enable it, recordings and transcripts of calls, plus SMS content and delivery status.
  • Usage and device data — log data, IP address, and analytics about how you use the Service.
  • Payment data — processed by our payment provider; we do not store full card numbers.

3. How we use information

  • To provide, operate, secure, and improve the Service;
  • To place the calls and send the messages you configure;
  • To process payments and prevent fraud and abuse;
  • To record acceptance of our Terms (version, timestamp, and IP) for compliance;
  • To communicate with you about your account and support requests;
  • To comply with legal obligations and enforce our Terms.

4. How we share information

We share information with subprocessors that help us run the Service — for example, telephony and voice-AI providers to place calls, language- model providers to power the agent, cloud hosting and database providers, and a payment processor. We share only what is needed to provide the Service, and we do not sell personal information. We may also disclose information to comply with law or protect our rights.

5. Cookies and similar technologies

We use essential cookies to operate the Service — primarily authentication cookies that keep you signed in and protect your session. These are required and cannot be switched off. With your consent (via the cookie banner), we may also use a small number of analytics cookies to understand how the Service is used and improve it; choosing “Essential only” disables them. We store your choice in your browser so we don't ask again, and you can change it anytime by clearing site data for this domain. We do not use advertising or cross-site tracking cookies, and we do not sell information collected by cookies.

6. Mobile information and text-messaging opt-in data

This section applies to phone numbers and text-messaging consent (“mobile information”) collected in connection with any text-messaging program run through the Service, and it controls over anything else in this Policy:

  • No mobile information will be shared with, sold to, or transferred to third parties or affiliates for marketing or promotional purposes.
  • Text-messaging originator opt-in data and consent will not be shared with, sold to, or transferred to any third party or lead generator. All other categories of sharing described in this Policy exclude text-messaging originator opt-in data and consent.
  • The only sharing of mobile information we perform is with subcontractors strictly to operate the messaging program itself — for example, our telephony carrier solely to deliver the messages you send, and customer-support providers assisting with the program. These providers may not use mobile information for any other purpose.
  • Recipients can revoke messaging consent at any time by replying STOP, and can get assistance by replying HELP. Opt-outs are recorded and enforced.

7. Call recordings and transcripts

Recordings and transcripts are created only when you enable them. Because these can be sensitive and are governed by wiretap and biometric-privacy laws, you are responsible for any required announcements and consents (see the Terms, Section 6.6). You control retention and deletion of this content within the Service.

8. Data retention

We retain account and campaign data for as long as your account is active and as needed to provide the Service. As a default schedule after account closure: call recordings and transcripts are deleted or anonymized within 90 days; opt-out and do-not-call lists are retained indefinitely so they continue to be honored; and consent and DNC compliance records are kept at least five years, matching Terms Section 6.9. Longer periods apply where the law requires them. You can delete contacts, campaigns, and recordings in the app at any time.

9. Security

We use administrative, technical, and organizational measures to protect personal information, including encryption in transit and access controls. No system is perfectly secure, and we cannot guarantee absolute security.

10. Your privacy rights

Depending on where you live, you may have rights to access, correct, delete, or port your personal information, or to object to or restrict certain processing (for example, under the CCPA/CPRA or GDPR). To exercise rights over your account data, contact us below. If your request concerns data you uploaded about someone else, that person should contact you as the controller; we will assist you as your processor.

11. International users

We operate in the United States, and your information may be processed there and in other countries where our providers operate. Those countries may have different data-protection laws than yours.

12. Children

The Service is not directed to individuals under 18, and we do not knowingly collect their personal information.

13. Changes to this Policy

We may update this Policy from time to time. Material changes will be reflected in the version and effective date above.
